Because of issues at the police station, the booking video was not produced. However, because the police lost the clients booking tapes, the client had a major advantage at trial. He was ultimately found not guilty of the charge.
Northborough Police Arrest Client for OUI 1st Offense: Client Found Not GuiltyIn this case, the Northborough Police arrested the defendant after allegedly making marked lane violations and after failing field sobriety tests; the police said that when the defendant got out of the vehicle she was unsteady on her feet and had slurred speech. The booking video we were able to obtain from the Northborough Police Arrest showed that the defendant was not slurring her words nor did she appear to be under the influence of alcohol. After trial, the defendant was found not guilty on the OUI 1st Offense charge.
The cruiser cameras are very rare and will record what the cruiser is looking at. This is a good opportunity for an experienced OUI attorney to set up a defense as this cruiser camera will show how the client drove and performed on the field sobriety tests.
