RECENT CASE RESULT FROM WAREHAM DISTRICT COURT
Our client was charged with OUI after a stop by the State Police. Our client was adamant from the day he came in that the officer exaggerated the traffic violation and that he did not cut the officer off, but that the officer was speeding. The client was at odds with he officer’s version of events and disputed almost the entire report from the first meeting. This was a case where to get across the client’s point and make it most effective we had to have him testify and prepared him to take the stand. The client did very well on the stand, explaining he drank socially and did not think he was impaired. After a jury trial, he was found not guilty of OUI.
Having defended OUIs case for over 15 years, I frequently get calls from individuals who hired other lawyers and now regret entering into a plea. Resolving the case is not the right decision for everyone and should only occur after all possible defenses are reviewed.
What are some of the steps to prepare your defense? In some cases, visiting the scene where you were stopped can be critical; as it may point out a confusing area of the road where you drove safely or it could point out a reason for any alleged erratic driving. Also, by going to the area of your arrest, I can see under what conditions you were asked to perform field sobriety tests, which include roadside exercises like a one leg stand test, the nine step walk and turn and sometimes an eye test referred to as the Horizontal Gaze and Nystagmus test. As an experienced Wareham, Massachusetts DUI lawyer, Attorney DelSignore has successfully defended many cases, by challenging the results of field sobriety tests, discrediting the accuracy of the police report, undermining the officer's report by and by excluding breathalyzer readings from evidence and pointing out the unreliability of breathalyzer testing.
