When you face a charge of OUI Motor Vehicle Homicide in Massachusetts, you should be aware of the following 3 important details.
1st: At your first court date the Arraignment, there may be family members of the victim present at your first court hearing. It is important not to speak to anyone entering the court, leaving the court, and during court as your lawyer will do all of the talking for you. You want to be nothing but respectful toward the family. The family suffered a loss; you can contest whether you are not guilty at the same time as being respectful to the family. Do not attempt to even express any condolences or speak to the family in any way.
2nd: You want to have a lawyer with you at the Arraignment, because bail could be an issue as well as conditions of release. You almost certainly will have to refrain from alcohol and be subject to random alcohol testing. The Court may require a cash bail depending on your record. With a serious charge and the potential jail time, if you have no record, the court still may require a nominal bail of 1000.00. If the clerk released you on bail or on person recognizance, that goes along way as many judges will impose the same bail set by the clerk magistrate.
3rd: Evidence could disappear if not preserved so we want to put a plan in place to begin investigating the case and require the court to preserve any evidence critical to the defense.
These 3 things are very important when charged with OUI Motor Vehicle Homicide in Massachusetts.
It is also important that you obtain alcohol treatment; with any charge of motor vehicle homicide offense, you are going to want to try to work out a resolution with the Commonwealth.
