What type of evidence can you expect on your OUI offense? The evidence in an OUI case consists of the testimony of the officer, other civilian witnesses and any video evidence. You can admit other evidence but this is the most common types of evidence.
The Hingham police department will have cruiser and booking video of your arrest. Video from the police car is not very common; however, the Hingham police are one of a handful of departments that have police cruiser video.
In a recent second offense trial, that I had in Hingham District Court, the prosecutor offered the cruiser video into evidence. The officer testified that the client missed heel to toe on the nine step walk and turn; when you watched the video, it appeared as though his feet were close together. Attorney DelSignore was able to minimize the officer's testimony on that aspect of the case and suggest that the officer was being extremely critical in his evaluation of our client's performance on the exercise.
What if it is not your first OUI offense?I see many clients who have been charged with a second offense OUI. These clients, along with first offenders, often ask about the potential license loss and ability to obtain a hardship license. A second offense drunk driving may offer the possibility that a motorist is eligible for what is known as a Cahill disposition, which you can read about by clicking here. Obtaining a hardship license is easier when you are facing your first offense, but with a second offense it requires the court to treat your second offense as a first offense. If your two offense are separated by ten years, you can receive a much shorter license loss provided you have the ignition interlock device installed in your car.
By thoroughly reviewing the facts and circumstances of your case, Attorney DelSignore will fight for your rights and may even be able to exclude evidence by challenging evidence, including the results of breathalyzer examinations and field sobriety tests, or evidence seized during a search of your vehicle.
As a dedicated DUI lawyer in Hingham, Attorney DelSignore is a member of the National DUI College and attends annual meeting regarding current changes to DUI laws in Massachusetts and throughout the country.

In this case, our client was charged with OUI by the Hull Police. She was stopped after police observed her to be swerving, making several marked lane violations. In the police report, officers mentioned that she had red and bloodshot eyes, slurred speech, had an odor of alcohol, and failed the field sobriety tests asked of her. The evidence showed that the roadway was confusing and that the client was driving appropriately in the given area. After a bench trial, the client was found not guilty of OUI!
