An overview of the court process:
1. Arraignment: Your arraignment date will be your first appearance in court. This is generally a very quick date, as you will simply go in front of the judge, have your charges read to you, and you will enter a not guilty plea to any and all of the charges.
2. Pretrial Hearing: A pretrial hearing is essentially a day for your defense attorney and the prosecution to touch base. At court this day, a DelSignore Law will request any outstanding evidence we feel is necessary, and may request to schedule a motion hearing date. You may have on pretrial date, but it is very common to have 3 or 4 pretrial dates as necessary.
3. Motion Hearing: A motion hearing is an opportunity for us to challenge something in your case, such as statements you made to the arresting officer. Basically, we are trying to exclude any incriminating evidence against you so that it cannot come into your trial. It also gives us a substantial look into the prosecutions case if we have to take the case to trial.
4. Trial: Your trial can last anywhere from a couple of hours to a full day (sometimes more). As your trial is approaching, we will discuss whether or not you wish to have your trial in front of a judge or if you wish to have your case heard before a jury of your peers.
